User Agreement

1. Terminology

This user agreement (hereinafter referred to as — Agreement) uses terms that have the following meaning: 

1) support service — a company that has rights to use the MediaBrama system to provide services to users and administer the MediaBrama system; 

2) webmaster — a user who has an account in the MediaBrama system and is currently using the MediaBrama system’s ad broadcast partner program on his (owned or operated) website; 

3) advertiser — a user who has an account in the MediaBrama system and is currently using an advertising campaign in the MediaBrama system; 

4) partner — webmaster or advertiser; 

5) user — any person, including a partner, using the search and/or advertising services of the MediaBrama system; 

6) platform (website) — a set of related html pages on the same domain; 

7) announcement (teaser) — image, title, price and text description. 

2. General provisions

This Agreement determines the procedure for using the search and advertising services of the MediaBrama system. To use the services of the MediaBrama system, the user must have a computer or other supported device and access to the Internet. All issues related to the acquisition of Internet access rights, the purchase and commissioning of equipment and software products required for this purpose are not subject to the Agreement and are resolved by users independently. 

3. Rules for using system MediaBrama

3.1. Description of services

The search service of the MediaBrama system provides users with online search services on the Internet for news information on a topic of interest to the user. All currently existing services, as well as those that will appear during the development of MediaBrama, are subject to this Agreement. 

For all information, data, text, programs, music, photos, graphics, audio, video, and other materials (content) posted for public access, the author of the content is responsible. 

Using the MediaBrama system search service, the user can view content that is offensive, indecent or objectionable. 

The support service is not required to review all content before it is made available to the user through the MediaBrama services. However, the support service has the right, at its sole discretion, to refuse to post content or remove any content from the MediaBrama pages without explanation. 

The user independently evaluates all risks associated with the use of the content, including an assessment of its reliability, completeness and usefulness. 

The use of the MediaBrama system search service is free of charge. 

3.2. Terms of cooperation with news sources

The MediaBrama system search service rebroadcasts only headlines, preambles of news and graphic illustrations to them, which are publicly available on the Internet, and also indicates a link to the source of this information without fail. 

In case the news source does not want any information to be relayed by the MediaBrama system, he must notify the support service of his decision by e-mail or by filling out the feedback form posted on the site. In this case, the news source and all its news will be deleted from the MediaBrama system search service database within three days from the date of notification. 

If the site is noticed in “cheating” traffic (autosurfing, viewing members’ pages, etc.), as well as self-installing links from the site MediaBrama to other sites, such a resource will be excluded from the search service of the system { $PP_SYSTEM_NAME} without warning. 

The support service is not responsible for the unavailability of the resources found by the MediaBrama system search service, for their content, as well as for any consequences associated with the use of the content of these resources. 

4. Rules for participation in the system as an advertiser

4.1. Advertiser website requirements

Advertiser websites must meet the following requirements: 

1) it is forbidden to advertise websites in the MediaBrama system, the content of which contains:

a) propaganda of violence, racial or any other discrimination, a campaign against an individual, group or organization, any further incitement to commit criminal acts; 

b) information about hacking computer systems and programs; 

c) insulting the religious feelings of believers of any denomination; 

d) obscene language and/or images; 

e) information of erotic and pornographic content; 

2) compliance with the legislation in force in the country of the physical location of the server, Ukrainian and international legislation; 

3) it is forbidden to advertise websites that exactly copy any other portals without the consent of the copyright holders; 

4) According to anti-virus systems, advertising websites infected with viruses and other programs that can harm visitors’ computers is prohibited. 

4.2. Ad requirements

The advertiser can experiment with advertisements (teasers) in the MediaBrama system if it does not violate a number of rules: 

1) the graphic file type must be gif, jpg or png; 

2) the physical size of the uploaded graphic file must not exceed 75 kb; 

3) image must not contain:

a) materials that violate the current legislation of the country of the physical location of the server of the advertised site, Ukrainian and international legislation; 

b) sharp transitions between frames and other features that can cause inconvenience to users when viewing; 

c) use of logos of well-known companies without their official consent, as well as the use of any other intellectual property of third parties without the consent of the copyright holders; 

4) title and text description should not contain:

a) obscene language and/or images; 

b) propaganda of violence, racial or any other discrimination, a campaign against an individual, group or organization, any further incitement to commit criminal acts; 

c) insulting the religious feelings of believers of any denomination; 

d) symbols and letter combinations that make it difficult for visitors to perceive advertising material. 

5. Service fees and refunds

All clicks (quality, according to the support service) made by users on the advertiser’s ads are paid from the advertiser’s balance at a cost determined by the ad settings approved by the advertiser. 

Funds deducted from the advertiser for low-quality transitions (according to the support service) are returned to the advertiser’s balance. 

6. Financial calculations

The advertiser makes 100% prepayment for the services rendered to him. 

The advertiser’s debit statistics are maintained by the MediaBrama system and are displayed in the account interface. 

Methods and procedures for payment for services are described in the interface of the advertiser’s account, which is accessed by entering a unique login and password. 

Unused funds are not refunded to the advertiser. 

7. Limitation of liability

The support service reserves the right to refuse to accept or block any advertising campaign or advertiser’s account without explanation. 

The support service is not responsible for the non-delivery of e-mail messages due to technical problems on the Internet, communication failure, hosting issues, anti-spam filters and other reasons that are not dependent on the MediaBrama system. 

The support service reserves the right not to return funds spent on clicks that are of poor quality, according to the advertiser, but not recognized as such by the support service. 

The advertiser is fully responsible for the safety of his login and password for accessing the advertising service of the MediaBrama system and for losses that may arise due to unauthorized use of his login, password and/or access channel. The MediaBrama system is not responsible and does not compensate for losses incurred due to unauthorized access of third parties to the interfaces of the advertiser’s account. 

The advertiser is not entitled to transfer to third parties his login and password, which allow access to the advertising service of the MediaBrama system. All actions requiring the use of a login and password are considered to be performed by the advertiser. 

The support service notifies that all disputes (claims) to the quality of services (work of the service) cannot concern, are not accepted, are not considered for a period of more than 30 (thirty) calendar days. 

8. Final provisions

Acceptance of this Agreement by the user is a prerequisite for using the services of the MediaBrama system. A user who uses the services of the MediaBrama system is considered to have accepted all the terms of this Agreement. 

By accepting this Agreement, the Partner agrees to receive e-mails from the support service to the e-mail address specified during registration with notifications of changes in the operation of the service, statistics on the user’s work, service messages and other information materials about the operation of the MediaBrama system. 

In case of violation of this Agreement by the partner, the support service has the right to suspend the display of ads on the partner’s website/from the advertiser and/or block the account. In each specific case, the issues of compliance with this Agreement are resolved individually with the partner; however, the support service reserves the right to block the site/advertising campaign or account at any time without explanation. In the event of a change in the owner (contact person) of a website using an account in the MediaBrama system, the partner is obliged to notify the support service of the MediaBrama system within three days to obtain a new account. 

Users are not entitled to reproduce, duplicate, copy, sell and resell, or use the services of the MediaBrama system for any commercial purposes without the written permission of the support service. The user has no right to hack technologies, as well as decompile the codes of software products obtained from the site MediaBrama. 

The MediaBrama software may only be used if it is downloaded from the MediaBrama official website or obtained directly from the support team. 

Users use the MediaBrama system at their own risk. The support service does not guarantee that the services will meet the requirements and expectations of the user and will be provided continuously, quickly, reliably and without errors. 

Support is not responsible for delays, failures or deletion of any user personal information. 

The support service is not responsible for damage that may be caused to the user’s computer and his data as a result of downloading materials found on the Internet using the MediaBrama system. 

The support service is not responsible for any direct or indirect losses incurred as a result of the use or inability to use the services of the MediaBrama system. 

Any data and technical information that the MediaBrama system uses to provide services and technical support is not used for commercial distribution and is not subject to disclosure. 

Any correspondence between the Support service and partners is a commercial secret and is not subject to disclosure to third parties, except as law requires. 

This Agreement is a legally binding agreement between the user and the support team. 

The support service reserves the right to change this Agreement at any time without the consent of the users. Users are obliged to monitor changes to this Agreement on their own.
